By accessing or using Monster Chatter, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
Our services integrate with Fanvue, a platform that hosts adult and mature content. Therefore, you must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to use Monster Chatter. By using our service, you represent and warrant that you meet this age requirement.
Monster Chatter provides automated AI chatting solutions for creators on the Fanvue platform. We integrate with your Fanvue account via OAuth to read incoming messages and automatically send AI-generated replies and voice notes based on your configured prompts.
Third-Party Affiliation: Monster Chatter is an independent third-party developer tool and is not officially affiliated with, endorsed by, or owned by Fanvue. You acknowledge that Fanvue's API rules and terms of service regarding automated bots may change at any time. It is your sole responsibility to ensure your use of our automated chatting service complies with Fanvue's current Terms of Service. Monster Chatter is not responsible for any API rate limits, revoked tokens, or account suspensions imposed by Fanvue.
If you are an agency, manager, or third-party entity operating a Monster Chatter account on behalf of a Fanvue creator, you legally warrant and guarantee that you have the creator's explicit, documented consent to connect their account, process their fans' messages, and generate AI responses on their behalf. You agree to bear full liability for any unauthorized access or operation of a creator's account.
Our service integrates with ElevenLabs to generate voice notes. By using the voice cloning feature, you explicitly warrant that you have the documented, legal consent of the individual whose voice is being cloned. You agree NOT to use the voice feature to generate deceptive, defamatory, non-consensual, or otherwise harmful deepfake audio. Violation of this clause will result in immediate account termination and potential reporting to relevant authorities.
You agree to use our service only for lawful purposes. You are solely responsible for the content of the system prompts you create and the resulting messages sent by the AI on your behalf. You must not use our service to send spam, harass others, or violate Fanvue's own Terms of Service.
You retain all ownership rights to the custom prompts, context, and settings you provide to Monster Chatter. Furthermore, you retain all rights to the AI-generated responses and audio produced on your behalf. Monster Chatter claims no copyright or ownership over the generated conversations or your proprietary prompt engineering.
AI Behavior: Artificial Intelligence can sometimes produce unpredictable, inaccurate, or inappropriate responses (often referred to as "hallucinations"). You acknowledge that you are using this automated service at your own risk. Monster Chatter shall not be held liable for any damages, loss of followers, account suspension on Fanvue, or reputational harm resulting from messages sent by our AI on your behalf.
We provide the service "as is" without any warranties of any kind.
You agree to defend, indemnify, and hold harmless Monster Chatter, its affiliates, and its employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service, or any illegal, harassing, defamatory, or copyright-infringing content generated by the AI as a result of your custom prompts or account configuration.
Certain features require a paid subscription or the purchase of credits. Our pricing tiers and feature limits are clearly displayed on our Fanvue App Store listing with no hidden charges. All payments for our application are processed directly via the Fanvue App Store billing system, and all purchases, cancellations, and refunds are strictly subject to Fanvue's official payment and refund policies. Monster Chatter does not directly process or store your credit card information.
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last Updated" date, or via a notification in your dashboard. Your continued use of the service after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Italy, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
By agreeing to these Terms, you also agree to our Data Processing obligations. As outlined in our Privacy Policy, you (the Agency/Creator) act as the Data Controller, and we act as your Data Processor. You instruct us to process personal data strictly to provide the automated chatting service. We commit to ensuring confidentiality, assisting you with data subject requests, and securely deleting personal data upon the termination of your account, fully satisfying the requirements of Article 28 of the GDPR.
We reserve the right to suspend or terminate your account at any time, with or without cause, especially if we determine you have violated these Terms of Service or Fanvue's Terms of Service.
Monster Chatter relies on third-party APIs including Fanvue, OpenRouter, and ElevenLabs. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to third-party API outages, internet service provider failures, denial of service attacks, acts of God, war, or governmental action.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Monster Chatter regarding the use of the service, superseding any prior agreements or understandings.
